
AB 49 – Immigration Enforcement Board Policy
Immigration Officers shall not be allowed to enter non-public areas of the campus locations.
Upon confirmation of an immigration enforcement officer’s presence, the Learning Center Staff member will immediately notify the Implementation Director or Executive Director. Should they not be available, a Director will be notified and will follow the safety protocols for the Learning Center.
Immediate action will be taken for the safety of all students and staff, which is the top priority. Any/all school personnel are directed to report any requests from immigration officials to the Implementation Director and Executive Director and not provide any information or access without proper judicial authorization and appropriate instruction.
The staff member will:
-Approach the officers only if it is safe to do so.
-Request paperwork which may include: warrant, court order, or subpoena
-Collect the identity, agency, and purpose of the visit
-determine if the office is seeking access to non-public areas
The notification content will include:
-The date and time the immigration enforcement was confirmed at the Learning Center
-The specific location on school grounds where the confirmed presence occurred
School personnel shall not disclose the personal information, citizenship, or immigration status of any student, parent, or staff member to immigration enforcement without a federal judicial warrant or court order or as otherwise required by federal law. This policy ensures that personal information remain confidential and is not shared for the purpose of immigration enforcements.
If a federal judicial warrant or court order is received, a Director will contact appropriate authorities to verify the authenticity of the documentation/paperwork (such as: police, sheriff, legal counsel).
